Question about Microsoft Surface Headphones 2

Hello experts I am currently trying to connect my new MS Surface 2 to the TV via an inakustik Bluetooth Audio Transmitter. The pairing works fine. However, when I take the headphones off, it goes into pause mode, and that's where it stays. I have to pair again to continue listening. Is this a known problem?

Tapping with 2 fingers on the right shell should interrupt the pause even if the headphones are off. furthermore, the function can be turned off in the Surface headphones app (for pc) from microsoft if I'm not mistaken.
